The following definitions shall be used throughout this document. In each case, words importing the singular include the plural and vise versa.

"Argus" shall mean Argus Machine Co. Ltd.

"Product" shall include products originally manufactured by Argus.

"Customer" shall mean original purchaser or original retail purchaser in the event of a supplier selling the Product.
1. Argus Products are manufactured to the highest standards and are warranted to meet Argus' criteria. Products have been tested by Argus' quality program ensuring the integrity of the Product. Oilfield operation may be exceedingly hazardous, therefore, Argus assumes no responsibility for consequential or incidental damage of any nature resulting from the use or misuse of the Products.
2. Products manufactured by Argus are warranted from defects in material and workmanship for a period of one year from date of shipment from Argus. This Warranty is effective when the Products are used within the service and pressure range for which they were manufactured. The Products are manufactured according to the appropriate industry standards. Additionally, corrosion due to severe service outside the intended application of the Product and the adhesion of foreign material to the working parts of the Products, are not covered by this Warranty.
3. If Argus accepts any claim made under this Warranty; Argus at its sole option, will either repair or replace the failed part or Product, or refund the purchase price less any devaluation for use of the Product prior to the claim. This Warranty does not cover deterioration by corrosion or aging of non-metallic parts, including stress corrosion or any other cause of failure other than defects in workmanship and materials.
4. In the case of Products or parts not wholly of Argus manufacture, Argus' guarantee or Warranty shall by limited to Argus' recovery from such manufactures under the manufacture's guarantee or Warranty to Argus.
5. This Warranty shall not apply to any product or part of a Product which has been repaired or altered by anyone other than Argus, or has become damaged due to misuse, negligence or casualty, or has been operated or maintained contrary to the Product's intended application.
6. Remedies available by virtue of this Warranty are expressly limited to an action to recover for the value of repairs or replacements to a maximum of the initial purchase price of the Product paid by the Customer.
7. All rights, duties, and obligations arising under this Warranty shall be governed by the laws of the Province of Alberta in the Country of Canada.
8. This Warranty is in lieu of all other warranties expressed or implied, including the warranty of merchantability and fitness for particular purpose, which is expressly disclaimed. Argus neither assumes nor authorized any other person to assume for Argus any other liability in connection with the sale of any Products other than as provided in this Warranty.
9. Claims under this Warranty must be made in writing within fifteen (15) days of any failure and sent by registered mail to the following address: 5820-97th Street, Edmonton, Alberta T6E 3J1. Failure to notify Argus of any failure within the fifteen (15) days will result in the Warranty becoming null and void. Any failed Products or parts must be shipped prepaid to Argus' facility.
